This privacy policy (the “Policy”) describes information you provide to us, or we learn from your use of this website (the "Site") and constitutes a legal agreement between you, as the user of the Site, and the Company, as the owner of the Site. The Policy will also tell you how we may collect, use, and in some instances share this information. Our policies do not apply to third-party websites that are connected via links to our Site and may differ from other service offerings and you should carefully review the terms of service and this privacy notice before using these services.

When you sign up for an ABCLearnings account or otherwise use the platform or services, ABCLearnings receives your information, which is controlled by ABCLearnings according to this Privacy Policy.

ABCLearnings is solely and independently responsible for its own privacy practices. No Member is responsible for ABCLearnings’ privacy practices.

Each of the Users are solely and independently responsible for their own privacy practices. No user is responsible for another user’s privacy practices; neither is ABCLearnings responsible anyone’s privacy practices.

By using the Services, you agree to the terms of this Privacy Policy. You shouldn’t use the Services if you don’t agree with this Privacy Policy or any other agreement that governs your use of the Services.

Any version of this Privacy Policy in a language other than English is provided for convenience and you understand and agree that the English language version will control if there is any conflict.


1        Personal Information

"Personal information" is any information that can reasonably be used to identify an individual and may include name, address, email address, phone number, login information (account number, password), or social media account information.

We collect certain information entered by yourself, data about your usage of the website, data from the third-party websites or services that you have connected with our website, and the devices you use to use our services. This is explained in the below sub-sections.


1.1       Information Provided by You

We will collect different information about you through forms. Below is the list of the information:

Account Information
While creating your account on our website, we collect and store your full name, phone number, and email address. Upon registration or social media login for the first time, an account is created for you and a referral code is assigned to you.

Profile Information
After registration, you will fill up your profile with additional details. Few of them are mandatory and the rest are optional. It includes your Profile Photo, Video Biography, Profile Heading, Biography, Country of Residence, State, Postal Code, Address, Time Zone, PayPal account ID.
Some of the information from your Profile is visible to everyone.
ABCLearnings encourages you to use discretion before voluntarily sharing additional Personal Information on the ABCLearnings Site.

Educational Usage Information
Whenever you create or access any content, including but not limited to the courses, assignments, exercises, progress history, all the communication with other users (instructor or learner), or any other communication content, your wishlist or saved courses.

Payment Information
While purchasing a course, we will collect some information which is needed to process your order, including tax calculations. This information includes your full name, postal code, and billing address.
When you publish or create a course, you will need to link your PayPal account to our website to receive the payments. This is also needed if you have referred someone and want to receive the referral fee.
Once you link your payment account, we will collect and use certain information, including your payment account email address, account ID, or other necessary information to make the payments to you. In compliance with applicable laws, we have collaborated with trusted third-party service providers (like Quaderno) who collect necessary information to provide tax liability of the purchaser as required. We may transmit the invoices to the tax authorities or any legal bodies, as necessary. These invoices will have your personal contact information like your full name, billing address, contact details, etc.
We will have access to your transaction history as well.

Feedback Information
Any ratings and reviews that you post for any course or instructor, or our website is available and viewable by everyone, along with your profile information.

Information through Communications
When you reach us for any support or report any issue, we collect and store your contact information, messages, and any other type of data you have provided us, or we may collect from your profile and usage of our website.
We may use this information to assess your concern and respond appropriately.
We collect all the communication, including the chat history between any users.

Information from your social media
If you register/login to ABCLearnings using your social media, we ask your permission to access certain information from your social media account, which may include your name, profile picture, login email address, location, gender, birthday, list, and details of your contacts.
All these information is shared by your social media using their standard APIs. The privacy policies of these social medias determine the amount of information that can be passed to us.
All this information is stored and used by us and is associated with your account.


1.2       Information Collected Automatically

We collect certain information when you access our website, which includes the following:

System and Usage Information
When you use our website, we automatically record certain information that your web browser sends whenever you visit any website. These may include information such as your web request, Internet Protocol (IP) address, device type, operating system type and version, unique device identifiers, browser type, browser language, referring / exit pages and URLs, number of clicks, domain names, landing pages, pages viewed, and other such information. We use this information, which does not identify users, to analyse trends and to gather demographic information about the user base as a whole. We do not link this automatically collected data to personally identifiable information.
The IP address collected from you is used to determine your approximate geographic location.

We may share certain personal information about you with instructors, other students, your referrer (if any), third-parties performing services for us (like analytics, data enrichment, social media, promotions and surveys) for the purposes of operating our business, delivering, analysing, improving, securing, and customizing our website and services, sending marketing and other communications related to our website, and for other legitimate purposes permitted by applicable law or otherwise with your consent.

We may share personal information in the following ways:

  • With other users of the platform, which will include your profile information, except your email address and phone number.
  • If you post any reviews, it is visible to everyone; if you chat with some other user, the information is available to us
  • With Our Partners who helps us in promoting and distributing our services.
  • With social media and messaging services, when you advertise or promote your courses through these platforms.
  • With Credit-Granting Organizations for Continuing Education, if you take a course to fulfill a continuing professional education requirement.
  • With Analytics and Data Enrichment Services who helps us with various analytical services.
  • With our partners who provides services related to online classrooms.
  • With your instructors and other students in the live online classrooms.
  • To our partners and third-party service providers who helps us in running various promotions, surveys, and advertisements, as required by applicable law or in accordance with the rules of the promotion or survey.
  • With third-party Service Providers: We share your data with third-party companies who perform services on our behalf, like payment processing, fraud and abuse prevention, data analysis, marketing, and advertising services (including retargeted advertising), email and hosting services, and customer services and support. These service providers may access your personal data and are required to use it solely as we direct, to provide our requested service.
  • With law enforcement officials, government authorities, or other third parties as necessary to comply with legal process or meet security requirements; protect the rights, property, or safety of ABCLearnings / AstralSolutionz, our business partners, you, or others; or as otherwise required by applicable law.

5        How to Manage Your Data

We need your help to keep your personal information accurate and up to date. We provide options to access, correct, suppress, or delete your personal information:

  • You can view or edit your personal information and preferences online on https://abclearnings.com after logging in.
  • When ABCLearnings is acting as a “data controller”, you can exercise your rights of access and request corrections, suppression, or deactivations under applicable data protection laws.
  • When ABCLearnings is acting as a “data processor” and you wish to exercise your rights of access and request corrections, suppression, or deactivations, ABCLearnings will direct you to the data controller under the applicable data protection laws.
  • If you need additional assistance, or help with accessing, correcting, suppressing, or deleting your personal information, please feel free to contact us directly at privacy@abclearnings.com. We will respond to your request within 30 days. If we are unable to honour your request or need more time, we will provide you with an explanation.

5.1       Restrict or Object to the Processing of Personal Information

You have some options for managing Cookies and other Tracking Technologies. These include:

5.2       Access and Correct Your Personal Information

Your account on ABCLearnings has lot of information about you, many of which are directly editable by you, for example your name, your profile pic, video bio, profile bio, contact number, your address, billing addresses. Your chat history with other users is accessible in the communication dashboard.

If you are an instructor, all the details of your courses are available in the Instructor Dashboard. This includes the list of your courses, your students, financial statistics of your courses, ratings and reviews posted by other users against your courses, your calendar, and traffic analysis report.

If you are a learner, the details of your purchased courses are available in the student dashboard, where you can view the list of your purchased published courses, list of past, current, upcoming purchased online classes.

If you are a referrer, you can see the details of your referrals and the related earnings in the referral dashboard.

There are few exceptions in editing your personal information:

  • The login email address cannot ever be changed. Your login email address identifies you and must be unique.
  • ABCLearnings does not track or index every time or every place on our platform when or where a user may volunteer Personal Information, so ABCLearnings will not be able to help you locate or manage all such instances.

We encourage you to use discretion before volunteering Personal Information on our platform.

 

5.3       Delete Account and Personal Information

You can delete your account from your profile.

Deleting or terminating your account may have different effects or requirements depending on your role, as mentioned below. If you have multiple roles, the effects of each of the roles will be applicable to you.

In every case, once the account has been deleted, the action cannot be reversed. If you want to join ABCLearnings again, you will need to register using a different email ID. You cannot register with ABCLearnings with the same email ID which was linked to your deleted account. Once you register with a new email ID, this account will be a new account and no data can be transferred from your previous / other accounts.

Upon deletion, all your details will be safely retained by us and will not be shared with anyone unless otherwise for lawful and legal purposes.

5.4       Retention of your Personal Information

ABCLearnings will retain your Personal Information for as long as your account is active or as needed to provide you with services; to maintain a record of your transactions for financial reporting, audit, and compliance purposes; and to comply with our legal obligations, resolve disputes, enforce its agreements, and as otherwise permitted by applicable law.

Your Instructor and Referrer will also retain some of your Personal Information for as long as needed to provide you with services; to maintain a record of your transactions for financial reporting, audit, and compliance purposes; and to comply with the legal obligations, resolve disputes, enforce its agreements, and as otherwise permitted by applicable law.

Please note the even after your account is terminated, some or all of your data may still be visible to others, including without limitation any data that has been (a) copied, stored, or disseminated by other users (including comments on content); (b) shared or disseminated by you or others (including in your shared content); or (c) posted to a third-party platform.

Even after your account is terminated, we retain your data for as long as we have a legitimate purpose to do so (and in accordance with applicable law), including to assist with legal obligations, resolve disputes, and enforce our agreements. We may retain and disclose such data pursuant to this Privacy Policy after your account has been terminated.


6        Children’s Privacy

Individuals under the age of 18 can use our Services only in conjunction with and under the supervision of a Parent. In this case, the Parent is responsible for any and all activities of the Student. ABCLearnings encourages parents and guardians to take an active role in their children's online activities. We do not knowingly collect personal information from children without appropriate parental or guardian consent. If you believe that we may have collected personal information from someone under the applicable age of consent in your country without proper consent, please submit a request that it be removed to privacy@abclearnings.com.

 

7        Storage and Security

ABCLearnings stores information, including Personal Information, on the servers of companies (“Hosting Service Provider”) that we have hired to provide services. Your personal information may be stored in Singapore, India, the United States and in other countries where our “Hosting Service Provider” operates. If you are in the European Union, Switzerland, or other regions with laws governing data collection and use, you acknowledge that ABCLearnings and AstralSolutionz may transfer, process, and store your personal information in Singapore, India, the United States and other countries, the privacy laws of which may be considered less strict than those of your region.

We take reasonable and appropriate steps to protect the personal information entrusted to us and treat it securely in accordance with this Privacy Statement. We implement physical, technical, and organizational safeguards designed to protect your personal information from accidental or unlawful destruction, loss, alteration, unauthorized disclosure, or access.

Unfortunately, no system, no method of transmission over the Internet, or method of electronic storage can be 100% secured, so we cannot guarantee that communications between you and us, the Services, or any information provided to us in connection with the data we collect through the Services will be free from unauthorized access by third parties. Although we make sufficient efforts to ensure the integrity and security of our systems, we cannot guarantee that its security measures will prevent "hackers" or other unauthorized persons from illegally accessing or obtaining information.

Your password is an important part of the security system, and it is your responsibility to protect it. You should not share your password with any third party, and if you believe your password or account has been compromised, you should change it immediately.

If ABCLearnings learns of a security breach involving its copy of your Personal Information, we may attempt to notify you electronically so that you may take appropriate protective steps. By using our platform or providing your Personal Information to us, you agree that ABCLearnings can communicate with you electronically regarding security, privacy, and administrative issues relating to your use of our platform.

We reserve the right to change this policy from time to time, for any reason by posting the updated Policy to our Website with indication of the modification date at the top of this page. The additional notifications on any amendments will be sent to your email.

Modifications will become effective on the day they are posted unless stated otherwise. By continuing to use the Services following amendment of the Privacy Policy, you consent to be bound by the policies as amended. The revised Privacy Policy shall supersede all previous Privacy Policies.
